On April 24, 2013 the Office of Agricultural Law Enforcement-Bureau of Investigative Services conducted a sting operation on an unregistered intrastate moving company. The business known as Brains and Brawn Moving was brought to the attention of the Division of Consumer Services for operating without being licensed / registered with the Department as required by law. The owner was identified as Walter H. Brackin. Florida State Statue 507.07(1) requires a mover to be registered with the Department prior to conducting business or advertising to engage in the business.

The Division of Consumer Services and Agricultural Law Enforcement attempted to locate owner Walter Brackins. Investigators did finally locate and meet with Mr. Brackins, issuing him a written warning for operating without being properly licensed / registered with the Department. Mr. Brackins was also given information on how to become properly registered.

In March 2013, the Division of Consumer Services received information that Brains and Brawn / Heath Brackin was operating without being properly registered. The issue was turned over to law enforcement for followup. An undercover investigator with the Office of Agricultural Law Enforcement completed a deal with Brackin, at which time backup units moved in and arrested him.
